Connecticut Court Orders Complete Ban Of The Death Penalty

Ban now needs to be extended nationwide

Following the state's ban on the death penalty three years ago, the Connecticut Supreme Court extended to the ban Thursday to inmates who had already been sentenced to death.


In an opinion for the court, Justice Richard N. Palmer wrote that since the state passed a ban in 2012, it would be unconstitutional to execute the 11 men who had previously received death sentences.

Another example of an irrational decision that explains why our courts are not respected.

"This state's death penalty no longer comports with contemporary standards of decency and no longer serves any legitimate penological purpose," Palmer wrote.


"For those reasons, execution of those offenders who committed capital felonies prior to April 25, 2012, would violate the state constitutional prohibition against cruel and unusual punishment," Palmer continued.

Eduardo Santiago, who was found guilty of killing Joseph Niwinski in 2000 in a murder-for-hire scheme, challenged that exemption in court. He had been sentenced to death, but the Connecticut Supreme Court overturned that judgment and ordered a new penalty phase.

Mr. Santiago again petitioned the Connecticut Supreme Court arguing that the new law bars the death penalty in his case and such a sentence would violate the state constitution. 




“We are persuaded that, following its prospective abolition, this state’s death penalty no longer comports with contemporary standards of decency and no longer serves any legitimate penological purpose,” the court wrote in its decision Thursday. 

The court noted in its decision that Chief State’s Attorney Kevin Kane, Connecticut’s top prosecutor who represented the state in Mr. Santiago’s case, testified before the legislature when the ban was being debated in 2012 and said the law “could not pass constitutional muster.”

Still, the state opposed striking down the death penalty for those who committed crimes before the ban’s enactment. Senior assistant state’s attorney Harry Weller said in court papers that it was the state Legislature’s intent to keep the death penalty for crimes committed before the effective date and that the provision shouldn’t be struck down. 




A spokesman for the state’s attorney’s office said they were still reviewing the decision and had no comment. 

The court said in its ruling that even if the death-penalty ban was never enacted, it would be unlikely that an execution would be carried out in the foreseeable future. 

“The 11 men currently on death row in Connecticut are, at the least, many years, and most likely decades, away from exhausting all of their state and federal appeals and habeas remedies,” the court wrote.

Connecticut has only executed one person since 1973, in 2005.
